PLEASE READ THESE PAYMENT TERMS CAREFULLY. BY SUBSCRIBING TO THE PRODUCTS OR SERVICES THROUGH THE WEBSITE,
YOU AGREE TO BE BOUND BY ALL OF THE BELOW PAYMENT TERMS.
This website (www.examic.in) under the name and style “Examic EdTech” (the “Website”) is owned, operated and made available by Examic EdTech Private Limited, with its office at No. 2963, Ground Floor, Gokulam Main Road, Vani Vilas Mohalla, Mysore, Mysuru, Karnataka, India, 570002 (hereinafter, referred to as “Examic”, “we”, “us” and/or “our”, each of which term shall include our assignees and/or successors-in-interest).
This is a legal agreement between you (the person using, accessing, or subscribing to the products or services (as defined in the Terms of Use) and hereinafter, referred to as “you”, or “User” as per the context) and us.
Please read these payment terms (“Payment Terms”) carefully before subscribing to our products or services through the Website and making payment of the Fee. These Payment Terms have been shared with you basis your interest in subscribing to the products or services offered by us.
We request you to also go through the privacy policy available at https://www.examic.in/privacy-policy (“Privacy Policy”) and the terms of use available at https://www.examic.in/terms-of-use (“Terms of Use”) carefully before you decide to subscribe to and make payment of the Fee (as defined below) for any of the products or services. These Payment Terms, the Privacy Policy and the Terms of Use (together “Agreement”) together constitute a legal agreement between you and Examic.
All capitalized terms used in these Payment Terms and not specifically defined herein shall have the meaning ascribed to such term in the Terms of Use.
1. APPLICABILITY AND AMENDMENT
1.1 Examic, through the Website, offers Candidates (as defined in the Terms of Use) products or services for a subscription fee (“Fee”). These Payment Terms are applicable to any Fee paid or payable by you for availing the products or services. Your payment of the Fee signifies your acceptance of the Agreement and your consent to be legally bound by the same. If you do not agree to be bound by the terms of the Agreement, you should not make payment of the Fee.
1.2 We reserve the right to modify or amend these Payment Terms, for any reason, subject to providing notice to you and your continued subscription to the products or services will be deemed as your acceptance to such amendment. To make sure you are aware of any such changes, please review these Payment Terms.
1.3 In case of any inconsistencies or conflicts between the Terms of Use and these Payment Terms, these Payment Terms shall prevail to the extent of such inconsistencies or conflict.
2. PAYMENT
2.1 All Fee shall be payable in Indian Rupees. Please note that you will not be able to access the products or services unless you have paid the Fee. The pricing of the Fee is subject to change at our sole discretion.
2.2 Upon receipt of the Fee, we will provide you access to the products or services and will inform you about the provisioning the product and services you have signed up for.
2.3 The payment of Fee is subject to applicable taxes (including goods and services tax) payable by you under applicable law.
2.4 Once you are provisioned the product and services you have subscribed to, any payments made by you in relation to the same will be non-refundable. You further agree and acknowledge that no refund requests shall be accepted, and you hereby waive any right to initiate such requests under these Payment Terms.
2.5 You hereby authorize us to collect, process and facilitate the Fee electronically using third-party payment providers including gateways and/or aggregators (“Financial Service Providers”) vide integrated payment methods such as credit/debit cards, electronic funds transfers, mobile wallets, or any other methods as may be supported by our Website from time to time, at our sole discretion. You agree and acknowledge that we reserve the right to update or modify the existing payment methods without any prior notice to you.
2.6 These Financial Service Providers may (i) charge you a separate fee; and /or (ii) redirect you to an external website; and /or (iii) require your personal information; and /or (iv) require you to enter into a separate agreement, to use /access or complete the Fee payment. You agree and acknowledge that the services provided or personal information collected by such Financial Service Providers shall be governed by the terms of usage and privacy policy of such Financial Service Providers. We cannot and do not guarantee the adequacy of the privacy and security practices of the Financial Service Providers and suggest that you read such Financial Service Provider’s privacy policy, terms of usage and any other applicable policies in relation to the payment of Fee by you. Further, any agreement between you and a Financial Service Provider in relation to the Fee payment transaction will be an independent agreement between you and such Financial Service Provider and we will not be a party to such agreement.
2.7 You agree that you are solely responsible for all charges that occur through usage of such Financial Service Providers and acknowledge and agree to indemnify, defend, and hold harmless Examic, its affiliates and it’s and it’s affiliates’ agents, officers, personnel, directors, consultants, representatives, authorized users, employees, and assigns from any Loss (as defined hereunder) arising out of or related to the use of the Website or any purchase of the product or services. This obligation will survive your use of the Website and termination of your Agreement with us. For purposes of these Payment Terms and the Terms of Use, “Loss” means all losses, liabilities, damages, awards, settlements, claims, suits, proceedings, costs, and expenses including reasonable legal fees and disbursements and costs of investigation, litigation, settlement, judgment, interest, and penalties. Examic shall not be liable to you for any claims arising out of any act or omission on the part of the Financial Service Provider(s) including, but not limited to, any lost, stolen, or incorrectly processed payments. Examic expressly disclaims any responsibility and liability for all services provided by the Financial Service Provider(s).
2.8 We will not be responsible or assume any liability, whatsoever, in respect of any Loss or damage arising directly or indirectly to you due to:
2.8.1 lack of authorization for any Fee payment transaction/s, or
2.8.2 exceeding the preset limit mutually agreed between you and the Financial Service Provider(s) you deal with, or
2.8.3 any payment issues arising out of any transaction made by you in relation to the Fee through such Financial Service Provider, or
2.8.4 failure of the Fee payment transaction for any other reason(s).
2.9 Further, Examic is solely authorized to offer discounts / offers, if any, on the Fee. These discounts / offers are communicated on the Website or via direct communication to you from Examic via e-mail, SMS, phone, or such other means of communication, and can be availed only through the Website, unless otherwise specifically communicated by Examic. Other than Examic, no person, including any third-party platform, is allowed to offer any discounts on the Fee. Examic shall not be liable for any claims arising from such unauthorized discounts / offers offered by any person (including any third- party platform), other than Examic.
3. CUSTOMER SUPPORT TEAM
If you have any grievance with respect to subscription to any product or service, including any discrepancies and grievances with respect to processing of information, you can contact the grievance officer mentioned under the Privacy Policy.
4. ELECTRONIC RECORD
This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder as may be applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of the IT Act and the rules made thereunder that require publishing the rules and regulations, Privacy Policy and Terms of Use of the Website.
